You can buy a Gift Card both online and in our participating boutiques. At the time of purchase you can choose the amount of the Gift Card up to a maximum of €5000. Find out the list of authorized shops below:

Online Shop: All European countries to which shipping is planned, with the exception of Belgium and Holland. The Gift Card is also unavailable in the UK and Switzerland.

The Gift Card is valid for 5 years. You can use it in our official online boutique and in participating physical boutiques. You will not be able to use it in Outlets or any other online or physical retailer. You can use the Gift Card in a single payment, integrate the amount with another payment method or choose to keep part of its value for your next purchase. You can use the remaining credit both online and in one of the authorized boutiques.

Tod's Gift Card Terms and Conditions of Use

These Terms and Conditions of Use (Gift Card Terms) form the agreement between the customer (you and your) and Tod's S.p.A. (Tod's, we, us and our) in relation to the purchase, use and redemption of a Gift Card. These Gift Card Terms should be read in conjunction with our Website Terms and Conditions. Before purchasing or using a Gift Card, you must read these Gift Card Terms carefully. If you do not agree to these Gift Card Terms, you must not purchase a Gift Card, or use or redeem a Gift Card. Purchasing a Gift Card on the Website indicates your acceptance of these Gift Card Terms. If you have purchased a Gift Card at a Boutique and do not agree to these Gift Card Terms, you may return the Gift Card to a Boutique and receive a refund, provided the Gift Card is undamaged and you have not spent any value of the Gift Card.

If you are giving a Gift Card to another person, you should ensure that they are aware of the Gift Card Terms and that they must comply with them to use the Gift Card. YOU SHOULD BE AWARE OF SEVERAL KEY TERMS

Validity period: Gift Cards may only be redeemed within 5 years after the date of issue.

Limitation of liability: Our liability to you is limited under these Gift Card Terms and our liability for certain types of Loss is excluded. These limitations and exclusions of liability generally apply to any Loss suffered by you in connection with your use of a Gift Card or matters that are outside our reasonable control, except where the Australian Consumer Law prohibits limitations and exclusions of liability.
In particular, you are responsible for the use and safety of your Gift Card, and are liable for all transactions made on your Gift Card except where Tod's or its employees know or ought to know that you have not authorised the transaction. Gift Cards are to be treated like physical cash – to the extent that Gift Cards are lost or stolen, they will not be replaced or refunded by Tod's.

1. DEFINITIONS

1.1 Australian Consumer Law has the meaning given in section 4 of the Competition and Consumer Act 2010 (Cth), as amended, replaced or superseded from time to time.
1.2 Boutiques means Tod's partecipating boutiques located in Australia which are owned and operated by Tod’s Australia Pty Limited, an updated list of which can be found on our Website accessible using the address https://www.tods.com/slnk/participating-boutiques-gift-card-us (or any replacement page from time to tome).
1.3 Consumer has the meaning given in section 3 of the Australian Consumer Law.
1.4 Gift Card means either:
(a) an electronic gift card purchased from the Website or a Boutique and issued in electronic form as described in these Gift Card Terms; or (b) a physical gift card purchased from a Boutique.
1.5 Loss means any liabilities, losses, damages, costs and expenses (including legal costs and expenses, regardless of whether incurred or awarded) arising in contract, tort (including negligence) or otherwise, and Losses has a corresponding meaning.
1.6 Privacy Policy means our privacy policy, as amended from time to time and published on our Website accessible using the address https://www.tods.com/au-en/privacy-policy/ (or any replacement web page from time to time).
1.7 Returns Policy means our returns policy, as amended from time to time and published on our Website accessible using the address https://www.tods.com/au-en/return-boutique/ (or any replacement web page from time to time).
1.8 Website means our Tod's website (which can be found at https://www.tods.com/au-en/home/ or any replacement web page from time to time).
1.9 Website Terms and Conditions means the terms and conditions governing the use of our Website and the ordering, purchase and delivery of products available for purchase on the Website, as published at the relevant time on our Website accessible using the address https://www.tods.com/au-en/terms-and-conditions-of-sale/ (or any replacement web page from time to time).

2. PURCHASE OF A GIFT CARD

2.1 Gift Cards may be purchased:
(a) from the Website or a Boutique as an electronic Gift Card and will be activated once the nominated recipient receives a confirmation email; or
(b) from a Boutique as a physical Gift Card and will be activated on the purchase date.
2.2 A Gift Card can be loaded at the time of purchase with any amount between AUSD300 and AUSD6000 .
2.3 A Gift Card cannot be reloaded or topped-up.
2.4 Once purchased, an electronic Gift Card will be delivered to the nominated recipient email address in electronic form.

3. USE OF A GIFT CARD

3.1 Gift Cards may only be used for the purchase of Tod's branded products:
(a) in any Boutiques; and
(b) on the Website for deliveries in Australia.
3.2 Where you make a purchase that is of lesser value than the remaining value of the Gift Card, the unused value of the Gift Card will remain and may be used again for a future purchase. Where you make a purchase that exceeds the total remaining value of the Gift Card, you will be required to pay the difference by other available payment method(s) in accordance with the payment methods available in our Boutiques or on our Website.
3.3 Gift Cards are non-refundable, not reloadable and cannot be redeemed for cash or other tender, or be replaced or extended after expiry, or have their value replaced after expiry. Gift Card balances cannot be consolidated into a new Gift Card.
3.4 The Gift Card cannot be used to purchase other Gift Cards.
3.5 The Gift Card may not be used for advertising purposes or promotion of Tod's products or services, except with Tod's express prior consent. The Gift Card merely enables a mode of payment and is in no way intended as an investment instrument and/or a solicitation of savings.
3.6 The remaining value of the Gift Card can be verified from time to time:
(a) at a Boutique; or
(b) on the Website by accessing [https://www.tods.com/au-en/add-gift-card/] and providing the Gift Card number.

4. VALIDITY

4.1 Gift Cards may only be redeemed:
(a) if purchased at a Boutique, within 5 years from the date of purchase in the Boutique (or before any later expiry date stated on a physical Gift Card purchased from a Boutique); or
(b) if purchased on the Website, within 5 years from the date of receipt of the Gift Card by email,
(each a Validity Period).

4.2 Upon expiration of the Validity Period, the Gift Card cannot be renewed or used for the purchase of items and the remaining value of the Gift Card is non-refundable. 4.3 For the avoidance of doubt, Tod's is not responsible for any Loss should you fail to redeem the Gift Card within the Validity Period.

5. REFUNDS / RETURNS FOR GIFT CARDS AND PURCHASES MADE BY GIFT CARDS

5.1 Subject to clause 5.2 and the Australian Consumer Law, the Tod's Returns Policy will apply when returning a product purchased using a Gift Card and the refund will be credited to the Gift Card.
5.2 In the event of the return of a product originally purchased using more than one payment method, the refund will first be made according to the payment method used for the original transaction (e.g. credit card, debit card, PayPal account) up to the amount originally paid with that payment method; then, the remaining balance of the refund due will be transferred to the Gift Card used.
5.3 You may return an electronic Gift Card purchased at our Website within 14 days of purchase and receive a refund, provided the Gift Card is undamaged and you have not spent any value of the Gift Card. Subject to the Australian Consumer Law, the Tod's Returns Policy will apply when returning a Gift Card.

6. VARIATIONS TO THE TERMS

6.1 Tod's reserves the right to change any terms contained in these Gift Card Terms from time to time by publishing the updated terms on our Website. If we decide to do this, such change will take effect from the time of publishing only for Gift Cards purchased after that time. The change will not affect Gift Cards purchased before that time.
6.2 Additionally, Tod's reserves the right to change these Gift Card Terms for Gift Cards purchased previously:
(a) where reasonably required to comply with applicable laws in force from time to time, as well as the requirements or directions of any relevant Commonwealth or State Government Departments, bodies, agencies or public authorities; or
(b) where the change will not cause detriment to you.
To make such a change under this clause 6.2, Tod's will email the nominated user (at the latest email address you have provided us, if applicable) and publish an announcement on our Website, providing details of the change, 90 days before the change will take effect.
6.3 Tod's reserves the right to cancel any Gift Card for any reason at any time without any notice to you, on the condition that if Tod's elects to exercise this right, we must provide either a refund or replacement Gift Card for the remaining balance of the Gift Card.
6.4 Tod's reserves the right to rectify the balance of your Gift Card if there are reasonable grounds to believe that a clerical or accounting error has occurred.

7. CONSUMER GUARANTEES

7.1 Under the Australian Consumer Law (and other similar legislation of Australian states and territories), certain statutory guarantees are conferred in relation to the supply of goods or services to a Consumer (Consumer Guarantees).
7.2 If, under these Gift Card Terms, you acquire goods or services as a Consumer:
(a) that are a kind ordinarily acquired for personal, domestic or household use or consumption (PDH Good or Services), the operation of the Consumer Guarantees cannot be, and are not in these Gift Card Terms, excluded, restricted or modified; or
(b) that are not PDH Good or Services, we limit our liability for a failure to comply with any Consumer Guarantee (other than where to do so would otherwise cause all or part of this clause to be void) to, at our option:
(i) in the case of goods, repairing or replacing the goods or paying the cost of having those goods repaired or replaced; and
(ii) in the case of services, re-supplying the services or paying the cost of having the services re-supplied.
7.3 We do not exclude or limit the operation of the Consumer Guarantees under any other provision of these Gift Card Terms or in any other manner and you agree it is fair and reasonable in all the circumstances for our liability to be so limited.

8. EXCLUSION AND LIMITATION OF LIABILITY

8.1 You are responsible for the use and safety of your Gift Card, and are liable for all transactions made on your Gift Card except where Tod's or its employees know or ought to know that you have not authorised the transaction. Gift Cards are to be treated like physical cash – to the extent that Gift Cards are lost or stolen, they will not be replaced or refunded by Tod's. 8.2 In respect of electronic Gift Cards, Tod's will not be liable for the non-receipt or delay in the receipt of the Gift Card by you (or the addressee if you have purchased the Gift Card on behalf of someone else) for reasons beyond our reasonable control, including, without limitation: ,
(a) poor functioning or interruption of the communication lines and/or systems;
(b) provision of an incorrect email address; or
(c) the email sent by Tod's is treated by the recipient's system as spam or junk mail or is otherwise rejected.
8.3 To the extent permitted by law, we exclude from these Gift Card Terms all representations, guarantees, conditions, warranties, rights, remedies, liabilities and other terms that may be conferred or implied by statute, general law or custom (except any guarantee or right conferred under any legislation including the Australian Consumer Law, the exclusion of which would contravene legislation or cause part or all of these Gift Card Terms to be void). Any liability we have to you will be reduced by the extent (if any) to which you caused or contributed to the Loss.

9. PRIVACY

When you purchase a Gift Card we will collect, use and store your personal information that you provide to us. Unless restricted by applicable law, you agree that any and all personal information and other data relating to you collected by Tod's from the Website from time to time may be used and disclosed for such purposes and to such persons as may be permitted in accordance with these Gift Card Terms, our Privacy Policy and applicable legislation.

10. MISCELLANEOUS

1.2 Severability – If any part of these Gift Card Terms is found to be void, invalid, unlawful or unenforceable, that provision is deemed to be ineffective only to the extent of the prohibition, invalidity or unenforceability without invalidating the remaining provisions. The remaining Gift Card Terms remain in force and constitute a binding agreement between you and us.
1.3 Relationship between the parties – Nothing in these Gift Card Terms constitutes the parties as partners or joint venturers or agents for the other party or give rise to any other form of fiduciary relationship between the parties.
1.4 No waiver – We do not waive a right, power or remedy in connection with these Gift Card Terms if we fail to exercise or delay in exercising the right, power or remedy.

1.5 Force majeure – To the extent permitted by applicable law and subject to clause 7, we will not be liable to you for any failure to fulfil, or delay in fulfilling, our obligations caused by circumstances outside of our reasonable control.
1.6 Governing law – These Gift Card Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia and the courts having appeal from them.
1.7 Dispute resolution – If you have any issue arising out of these Gift Card Terms or in relation to the Gift Cards, you agree to notify us in writing and use reasonable endeavours to resolve the matter through discussions or correspondence with us before commencing any court or tribunal proceedings.
1.8 Interpretation – In case of any conflict or inconsistency between any provision of these Gift Card Terms and any provision of the Website Terms and Conditions, the provisions of these Gift Card Terms prevail over the provisions of the Website Terms and Conditions.
